These Terms of Service ("Terms") govern your use of the Nutrition + Fitness mobile application ("the app") provided by I Vidanelage Thusitha Pradeep Madhusanka Jayalath, trading as Glitchfy ("we", "us"). By downloading or using the app, you agree to these Terms. If you do not agree, please do not use the app.

1. Licence to use

We grant you a personal, non-exclusive, non-transferable, revocable licence to use Nutrition + Fitness for your own personal, non-commercial health and fitness purposes, subject to these Terms and the rules of the app store you downloaded it from.

2. Health & fitness disclaimer

Nutrition + Fitness provides general fitness and nutrition information for informational purposes only. It is not medical advice and is not a substitute for professional diagnosis or treatment. Calorie burn, body metrics, and goal timelines shown in the app are estimates, not guaranteed outcomes.

Always consult a qualified healthcare professional before beginning any exercise or dietary program, especially if you are pregnant, have a medical condition, or take medication. Stop any activity that causes pain or discomfort and seek medical help if needed. Review ingredients and adapt exercises to your own needs. You use the app, and undertake any workout or meal plan it suggests, at your own risk.

3. AI-generated content

The app's on-device AI coach can generate meal ideas and custom exercise routines. AI suggestions may be inaccurate or unsuitable for your circumstances — review them, and any generated plan, before following it.

4. Your content and device

Content you create in the app — your profile, logs, plans, journal photos and notes — is stored on your device. You are responsible for your device, for keeping backups where you wish, and for any content you generate. Uninstalling the app or clearing its data will permanently remove that content.

5. Acceptable use

You agree not to misuse the app, including by attempting to reverse engineer it (except where permitted by law), interfering with its operation, or using it for any unlawful purpose.

6. Intellectual property

The app, its content, design, and branding are owned by Glitchfy and protected by intellectual property laws. These Terms do not grant you any right to our trademarks or content beyond the licence to use the app.

7. Third-party services

The app's AI model download connects to Hugging Face and its delivery infrastructure, and app updates may connect to Expo's update service. Your use of the app may be subject to those providers' own terms. See our Privacy Policy for details.

8. The app is provided "as is"

Nutrition + Fitness is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including fitness for a particular purpose. We do not warrant that the app will be uninterrupted, error-free, or meet your requirements.

9. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential damages, or for any loss arising from your use of, or inability to use, the app, including any injury resulting from exercise or dietary activities undertaken through it.

10. Changes to the app and these Terms

We may update, suspend, or discontinue features, and we may revise these Terms from time to time. Continued use of the app after changes take effect constitutes acceptance of the revised Terms. The "Last updated" date above reflects the latest version.

11. Governing law

These Terms are governed by the laws applicable to our place of business, without regard to conflict-of-law principles.
